US Judge Penalizes Samsung For Withholding ‘Design-around’ Source Code From Apple

Foss Patents reports that Samsung has earlier argued that its recent implementation of the “blue glow” feature in TouchWiz is a non-infringing workaround to Apple’s patent (US 7,469,381) on the iOS “scrollback” behaviour. US Magistrate Judge Paul Grewal eliminating Samsung in the case by eliminating Samsung’s infringement defenses from the lawsuit. The story back lies in such a way is that Apple asked Samsung to provide specific code during the discovery stage of the litigation, but since Samsung not able to provide any evidence, the Cupertino-based Apple filed a motion requesting that the court order Samsung to comply resulting the US Judge to penalized Samsung for not presenting the source code.
