EU Court: End-Users Can Resale Used Software Licenses

Whoa, you will surely love this if you too want to get rid of software that you used already. Oracle found itself in the position as per the recent Europe’s Court of Justice of the European Union (CJEU) judgement, which was ruled on Tuesday stated that the software licenses can be sold on a second hand basis. The court order revises not only for the Oracle but put a big mark over to the whole of software industry operating system.

The CJEU said in a statement (PDF), “Where the copyright holder makes available to his customer a copy — tangible or intangible — and at the same time concludes, in return [for] payment of a fee, a licence agreement granting the customer the right to use that copy for an unlimited period, that rightholder sells the copy to the customer and thus exhausts his exclusive distribution right. Such a transaction involves a transfer of the right of ownership of the copy.”
